La masa pasiva del concurso de acreedores

Abstract

Five years after the previous edition of this book, it is now a new edition that reflects the avatars and at the same time takes advantage of the insolvency rule and the practical realism of an insolvency that has overflowed the dikes and continents of the Law of 2003. It has done so in such a way that it has happened during these fourteen years since the promulgation, and thirteen of time, not few, unconnected and badly coordinated reforms to the law. Reforms that have caused the crisis and the extraordinary crisis, due to its hardness and its economic effects that has desolated and devastated the landscape. To the number of competitions of creditors, not very high, everything must be said, has followed a very high number of dissolutions and liquidations of companies and individual companies that have not withstood the clashes experienced, but that, in one way or another, by some Or other reasons, have not resulted in insolvency proceedings. The irreversibility of the situation, the economic deterioration and the desert of goods and assets, has preferred to give up in passivity and nothing before opening processes that did not flow to any place. Today like yesterday, principles, dogmas, realities and futilities continue to be questioned. And in the area that concerns us, that of the passive mass, the privilege is questioned for the umpteenth time, the preference ultimately. It is clear that for the legislator, the explanatory motives are a suitable place for relief and complaint, a pity that it is not accompanied by this same firmness when the scalpel must dissect. Jurisprudence has nuanced, completed, criticized, amplified, severed virtually every one of the limits that credits, real or virtually not mentally, have had and have between doctrine and practitioners of rights. It has been corrected, reinterpreted, and even rewritten as well. Unusual but true. The passive mass continues to enjoy the centrality and nerveless spin of a bankruptcy procedure that continues to tilt away from the agreement and the solution of business continuity by antonomasia.
