Discurso del odio y racismo en el deporte: límites a la libertad de expresión en los eventos futbolísticos

Abstract

El presente trabajo analiza los límites jurídicos de la libertad de expresión en el contexto de los eventos deportivos multitudinarios, con especial atención a los estadios de fútbol. Partiendo del marco constitucional español y del artículo 20 de la Constitución, se examinan las tensiones entre el ejercicio de este derecho fundamental y la necesidad de preservar el orden público, la seguridad y la dignidad de las personas frente al discurso del odio, el racismo o la violencia. Asimismo, se estudia la aplicación de la Ley del Deporte, el Código Penal y la normativa administrativa sancionadora, así como la jurisprudencia relevante del Tribunal Constitucional y del Tribunal Europeo de Derechos Humanos. El análisis se complementa con el estudio de casos recientes de gran impacto, como el de Vinicius Júnior en el estadio de Mestalla (Valencia), que ilustran la respuesta institucional y judicial frente a manifestaciones racistas en el fútbol. Finalmente, el trabajo propone una valoración crítica del sistema vigente e identifica sus déficits estructurales, con el objeto de evaluar su coherencia constitucional y su ajuste al estándar europeo.

This paper analyzes the legal limits of freedom of expression in the context of mass sporting events, with a special focus on football stadiums. Based on the Spanish constitutional framework and Article 20 of the Constitution, the tensions between the exercise of this fundamental right and the need to preserve public order, security, and the dignity of individuals against hate speech, racism, or violence are examined. Furthermore, the application of the Sports Law, the Penal Code, and administrative sanctioning regulations is studied, as well as relevant case law from the Constitutional Court and the European Court of Human Rights. The analysis is supplemented by the study of recent high-impact cases, such as that of Vinicius Junior at the Mestalla stadium (Valencia), which illustrate the institutional and judicial response to racist manifestations in football. Finally, a critical assessment of the existing system is proposed, identifying its structural deficits in order to evaluate its constitutional coherence and compliance with the European standard.
