El genocidio de Ruanda y la ONU: ¿fracaso institucional o límites estructurales del Derecho Internacional Público?

Abstract

El presente trabajo analiza la actuación de Naciones Unidas frente al genocidio de Ruanda con el fin de determinar si su inacción debe interpretarse como un fracaso institucional o, más bien, como el reflejo de los límites estructurales del Derecho Internacional Público. A través del examen del marco normativo vigente en aquel momento, se estudian las decisiones y omisiones de los principales órganos de la ONU, así como los factores políticos y jurídicos que condicionaron su respuesta.

La respuesta de la Organización parece, a primera vista, sugerir un fracaso institucional. Sin embargo, este trabajo busca determinar si dicho fracaso era evitable o si, por el contrario, fue consecuencia de los propios límites del sistema jurídico internacional.

This study analyses the United Nations’ actions in response to the Rwandan genocide in order to determine whether its inaction should be interpreted as an institutional failure or, rather, as a reflection of the structural limits of Public International Law. Through an examination of the legal framework in force at the time, it explores the decisions and omissions of the UN’s main organs, as well as the political and legal factors that conditioned their response.

At first glance, the Organisation’s response seems to suggest an institutional failure. However, this research seeks to determine whether such failure was avoidable or, on the contrary, the result of the inherent limitations of the international legal system.
