Un estudio sobre los delitos de genocidio y terrorismo: desafíos del principio de tipicidad penal.

Abstract

La presente investigación analiza los desafíos que el principio de tipicidad penal afronta en el delito de genocidio y en el delito de terrorismo, tanto en el ordenamiento jurídico interno como en el plano del Derecho Internacional. El trabajo parte de la hipótesis de que las definiciones legales de ambas figuras son intrínsecamente indeterminadas, lo que genera una disfunción dual estructural: por un lado, impunidad sistemática por defecto en el genocidio, derivada de las dificultades probatorias del dolus specialis, y por otro lado, la sobreinclusión punitiva por exceso en el terrorismo, producida por la expansión constante de los tipos penales bajo presión securitaria internacional.

This paper examines the challenges that the principle of criminal typicity faces in the crimes of genocide and terrorism, both under Spanish criminal law and in the framework of Public International Law. This investigation is guided by the hypothesis that the legal definitions of both crimes are intrinsically indeterminate, generating a twofold structural dysfunction: on the one hand, systematic impunity by default in genocide, stemming from the evidentiary difficulties surrounding the dolus specialis requirement, and on the other hand, punitive overinclusiveness by excess in terrorism, produced by the constant expansion of criminal offences under international security pressure.
