La negociación en conflictos jurídicos como vía alternativa al proceso jucidical : comparativa entre el sistema español y estadounidense

Abstract

El objeto de este trabajo es analizar la figura de la negociación como sistema alternativo al proceso judicial clásico de resolución de conflictos en el sistema legal español realizando una exposición de las aportaciones del sistema estadounidense y una comparación de la regulación de la negociación en ambos sistemas. Para su elaboración se han estudiado el concepto, los elementos, las fases y técnicas de la negociación, así como las diversas manifestaciones de su regulación en el ordenamiento jurídico español y estadounidense.

The aim of this paper is to analyze the figure of the negotiation as an alternative to the classic judicial procedure dispute resolution system in the Spanish an American legal system, doing an explanation of the input of the U.S. system and a comparison of the regulation of the negotiation in both systems. In order to elaborate it, the concept, the elements, the phases and the techniques of the negotiation, as well as the different ways it is regulated in both legal bodies have been studied.
