Los fueros medievales vascos: una actualización del corpus histórico-juridico

Abstract

Este trabajo actualiza el corpus histórico-jurídico de los fueros medievales vascos mediante el análisis sistemático y comparado de los principales inventarios y catálogos existentes sobre la materia. Como punto de partida se toman las dos grandes obras de referencia —la Colección de fueros municipales y cartas pueblas de Muñoz y Romero (1847) y el catálogo de Barrero García y Alonso Martín (1989)— que se contrastan con las aportaciones más recientes de Ayerbe Iríbar (2019) para Álava y Guipúzcoa, y de Monreal Zia (2021) para Bizkaia. Con carácter previo al análisis inventarial, el trabajo sitúa el fenómeno foral en su contexto histórico, social y territorial, examinando la organización del País Vasco medieval, el proceso de avillazgamiento en los tres territorios históricos y las funciones política, económica e identitaria que los fueros desempeñaron. Se analiza asimismo la naturaleza pactista del fuero y su formación como instrumento de fijación escrita del derecho consuetudinario preexistente. El núcleo del trabajo consiste en el inventario y la comparación de los textos forales recogidos por cada una de las obras estudiadas, identificando coincidencias, discrepancias cronológicas y de atribución, textos ausentes en los catálogos más antiguos y correcciones introducidas por la historiografía más reciente. El resultado es una visión ordenada y actualizada del estado del conocimiento sobre el corpus foral vasco medieval, que pone de manifiesto tanto los avances producidos en los últimos años como las cuestiones que permanecen abiertas.

This dissertation updates the historical-legal corpus of medieval Basque fueros through a systematic and comparative analysis of the main existing inventories and catalogues on the subject. The two major reference works serve as a starting point — Muñoz y Romero's 3 Colección de fueros municipales y cartas pueblas (1847) and the catalogue by Barrero García and Alonso Martín (1989) — which are contrasted with the most recent contributions by Ayerbe Iríbar (2019) for Álava and Gipuzkoa, and Monreal Zia (2021) for Bizkaia. Prior to the inventory analysis, the dissertation places the foral phenomenon in its historical, social and territorial context, examining the organisation of the medieval Basque Country, the process of town foundation (avillazgamiento) across the three historical territories, and the political, economic and identity functions performed by the fueros. The study also analyses the pactual nature of the fuero and its formation as an instrument for committing pre-existing customary law to writing. The core of the dissertation consists of an inventory and comparison of the foral texts recorded in each of the works studied, identifying points of agreement, chronological and attributional discrepancies, texts absent from earlier catalogues, and corrections introduced by more recent scholarship. The result is an organised and updated overview of the current state of knowledge on the medieval Basque foral corpus, highlighting both the advances made in recent years and the questions that remain open.
