Trata de seres humanos con fines de explotación sexual : análisis jurídico y social del tipo

Abstract

La trata de seres humanos con fines de explotación sexual es un delito tipificado en el artículo 177 bis del Código Penal, incluido en nuestra legislación en el año 2015. De ahí que, al ser un tipo de reciente creación exista una laxitud en su regulación jurídica a nivel nacional e internacional (la primera definición consensuada de trata a nivel internacional se dio en el año 2000). El presente trabajo trata de analizar el marco jurídico que regula el delito, el perfil de las personas implicadas en el mismo y la diferenciación de tratamiento de la víctima cuando es mayor y menor de edad, para así comprobar si los protocolos de identificación, asistencia y protección de las víctimas existentes hasta la fecha son adecuados, así como los vínculos de la trata con la prostitución. El tema ha sido elegido por el interés que en la actualidad han despertado las víctimas de trata en la sociedad y la falta de información que está disponible al público en general, pues sigue siendo un tema tabú en la sociedad que a muchas autoridades no interesa sacar a la luz. Es por ello que este trabajo pretende hacer visible una realidad actual de este mundo globalizado, focalizando el interés no sólo en el castigo que jurídicamente se da a los delincuentes sino también en la asistencia y protección adecuada a las víctimas.

Human sex is an offense established in article 177 bis of the spanish Penal Code, included in our legislation in year 2015. Hence, being a type of recent creation there is a laxity in its legal regulation at national and international level (the first definition of human trafficking at the international level was stablished in the year 2000). The present paper tries to analyze the legal framework that regulates the crime, the profile of the people involved in its and the differentiation of treatment of the victim when he or she is adulto or child, in order to verify if the protocols of identification, assistance and protection for the victims are adequate. The pape also study the links between human sex trafficking and prostitution. The issue has been chosen because of the current interest in trafficking victims in society and the lack of information that is available to the general public, as it remains a taboo subject in society that many authorities are not interested in drawing to the light. That is why this work aims to make visible a current reality of this globalized world, focusing not only on the punishment that legally gives to criminals but also on the adequate assistance and protection of victims.
