La simplificación jurídica del emprendimiento : perspectiva comparativa

Abstract

El presente trabajo aborda la problemática existente en España de la regulación del emprendimiento como consecuencia de las numerosas trabas existentes para llevar a cabo el mismo, realizando un estudio acerca de cuál es la situación actual, teniendo en cuenta los aspectos mercantiles, administrativos y relativos a la financiación del emprendimiento, así como cuáles han sido las principales novedades aportadas por la Ley 14/2013, de 27 de septiembre, de apoyo a los emprendedores y su internacionalización . Asimismo, se estudia cómo funcionan figuras similares a las aprobadas en el sistema legislativo español en otros países del Derecho Comparado. Se incluye, finalmente, por parte del autor, un conjunto de críticas al sistema actual existente, aportando soluciones a los numerosos problemas que existen en este ámbito para lograr un entorno que potencie que aquellas personas con ideas emprendedoras puedan poner en marcha tales proyectos debido a la facilidad para llevar a cabo el mismo.

This paper addresses the existing difficulties in Spain of the undertaking regulations as a consequence of the numerous existing obstacles to carry away itself, taking into account the commercial, administrative and relative to financial aspects of the undertaking; in the same way, which have been the main news given by Law 14/2013, of 27 September, of support to enterprising and its internationalization. Likewise, it is studied how similar figures work, approved by spanish legislative system in other countries of Compared Law. It finally includes, in sense of the author, a combination of critics to the actual existing system, giving new solutions to the numerous problems that exist in this field, to manage an environment that strengthens those pepple with entreprising ideas that can give a start to those projects thanks to the facility to manage itself.
