La libertad de expresión en un contexto de convivencia multicultural

Abstract

En las sociedades europeas actuales, a raíz de una serie de fatales acontecimientos, se ha intensificado la reflexión en torno a las tensiones entre la libertad de expresión, derecho que se concibe como uno de los fundamentos de la sociedad democrática, y la libertad religiosa y cuestiones íntimamente relacionadas con ella. En el presente trabajo, se analizan las limitaciones derivadas de cuestiones religiosas a las que se puede ver sometido el derecho fundamental de la libertad de expresión en España, inmersa en un contexto europeo caracterizado por un creciente pluralismo de convicciones y credos. Dado que la protección otorgada por el Convenio Europeo de Derechos Humanos y la jurisprudencia desarrollada por el Tribunal Europeo de Derechos Humanos constituyen la referencia en la temática y han influido notablemente tanto en las normas sustantivas como en la evolución jurisprudencial de los tribunales españoles, al ser España miembro del Consejo de Europa, partiremos en cada una de las cuestiones a tratar de la perspectiva internacional de esta organización, para posteriormente analizar cómo se plantea la cuestión en el ordenamiento jurídico interno español. Ambas perspectivas deberían ser en gran medida coincidentes pero no idénticas, ya que los Estados aun reconociendo los derechos y libertades del Convenio Europeo de Derechos Humanos gozan de cierta libertad de actuación en determinadas cuestiones.

In today's European societies, after a series of fatal events, reflection on the tensions between freedom of expression, a right that is conceived as one of the basis of the democratic society, and freedom or religion and issues closely related to it, has intensified. In the following project we analyse the limitations derived from religious issues that may put under restrictions the fundamental right of freedom of expression in Spain, immersed in a European context characterized by a growing pluralism of convictions and creeds. Given that the protection granted by the European Convention on Human Rights and the case law developed by the European Court of Human Rights constitute the reference in the subject and have had a significant influence both on the substantive rules and on the evolution of the jurisprudence of the Spanish courts, we 2 will commence each matter with the international perspective of this organization in order to analyze afterwards how the subject arises in the Spanish legal system. Since the states recognize the rights and freedoms of the European Convention of Human Rights, both perspectives should be coincident, but not identical, as the states have a certain level of freedom on some matters.
