El Derecho a la Educación de los Niños: Un análisis del caso Tailandés

Abstract

La educación es un Derecho Humano Fundamental garantizado por diversos instrumentos normativos que obligan a los Estados a respetarlo y fomentarlo. En muchas ocasiones se trata de la única oportunidad con la que cuentan los niños que se encuentran en riesgo de exclusión social para salir de la pobreza y labrarse un futuro que les permita participar de pleno en la realidad social y económica de su comunidad. A pesar de ser un derecho reconocido por la mayoría de Estados, se trata a su vez de una materia para la que los éstos cuentan con diferentes medidas de aplicación. Este hecho da lugar en muchas ocasiones al abandono por parte de los gobiernos de aquel sector de la población que no cuenta con los medios necesarios para acceder a esta herramienta. En este trabajo se analizará el caso concreto de Tailandia, país que servirá para hacer un estudio sobre la situación oficial de ratificación de los tratados sobre el papel en contraste con sus esfuerzos reales puestos en marcha a lo largo del tiempo para cumplir con los objetivos a los que se ha comprometido.

Education is a Fundamental Human Right guaranteed by several legal instruments that bind States to its respect and promotion. In many cases, it is the only chance for children that are under risk of marginalization to escape poverty and make a better future for themselves, one that allows them to fully participate in the social and economic reality of their communities. Although it is a right recognised by most Nations, it is also a subject for which each country has different methods of enforcement. This fact leads in some cases to the government´s neglection of that sector of the population that does not have the necessary means to access education. This document will consist on the analysis of the specific case of Thailand, a State that will be the basis of a study that will allow to see the differences between the countries’ official position on the ratification of treaties and the real efforts that it has been implementing over the years to fulfil the goals it has set up itself to.
