Esta monografía analiza el alcance de la Decimotercera Enmienda a la Constitución de los Estados Unidos, norma que abolió la esclavitud. El estudio examina el origen histórico de la esclavitud en Estados Unidos, su constitucionalización, los debates políticos y jurídicos que precedieron a la abolición, la Proclamación de Emancipación y el proceso de reconstrucción constitucional. También aborda el contenido de la Decimotercera Enmienda, sus cláusulas principales, la excepción penal, la protección de derechos fundamentales, las primeras medidas legislativas adoptadas tras su aprobación y la aparición del denominado peonaje negro. La obra combina historia constitucional, derecho comparado y análisis jurídico para valorar el alcance real de la abolición y sus límites interpretativos.

This monograph examines the scope of the Thirteenth Amendment to the United States Constitution, which abolished slavery. It studies the historical origins of slavery in the United States, its constitutional entrenchment, the political and legal debates surrounding abolition, the Emancipation Proclamation, and the process of constitutional reconstruction. The book also analyzes the content of the Thirteenth Amendment, including its main provisions, the punishment clause, the protection of fundamental rights, the first legislative measures adopted under the amendment, and the emergence of so-called Black peonage. The work combines constitutional history, comparative law, and legal analysis to assess the real reach of abolition and its interpretative limits.
