La alteridad como búsqueda de sentido en la hermenéutica jurídica

Abstract

La alteridad se presenta como una realidad evidente, pero como todas las evidencias, parece darse por sentado y al final olvidarse. El objetivo de esta investigación, encuadrada en la línea de la Filosofía del Derecho Hermenéutica es redescubrir la importancia de “el otro”, fundamental en todas las áreas de la vida, y sobre todo en Derecho. Así pues, partiendo de la muerte de Sócrates como vivencia hermenéutica adelantada a su tiempo, pasando por los primeros hermeneutas académicos hasta Ricoeur, se rescata la importancia del aspecto práctico ineludible de esta disciplina. El Derecho responde a la necesidad reguladora de la convivencia, pero en su aplicación, el texto escrito por si solo muestra carencias para funcionar adecuadamente en la realidad que regula. Se posiciona en este momento el juez, como agente adaptador de la ley al caso, que consigue efectuar su labor jurídica guiado por un sentido de justicia que impregna y nutre al Derecho.

Alterity appears as a self-evident truth, but as every truth of this kind, it is sometimes taken for granted and therefore forgotten. The objective of this investigation, conceived around line of thought of Philosophy of Hermeneutics in Law, is to reminisce the importance of “the other”, crucial in every area of life, and specially in Law. Hence, parting from Socrates’ death as a hermeneutical experience ahead of his time, overviewing the first hermeneutic academics, to Ricoeur, bringing back the importance of the practical perspective of this discipline. Law appears as an answer to the need to regulate human coexistence, but in its application, written text on its own is found lacking to function adequately inadequate in the reality it governs. In this moment appears the role of judge, as an agent which adapts norms to the case, and manages to bring into effect his purpose guided by a sense of justice that imbues and nurtures the Law.
