Constitución económica y economía real. Un análisis a partir de la experiencia española

Abstract

Este trabajo nace desde la inconformista consideración de que la situación de sobreendeudamiento que sufre España no se corresponde con su situación privilegiada en aspectos como su cultura, su naturaleza, su climatología o su historia. España presenta unos niveles de deuda y desempleo tremendamente más altos que los de los países de su entorno pese a ser una potencia turística a nivel mundial. El aumento descontrolado de la deuda pública española en los últimos años acarrea consecuencias nefastas para la economía de sus ciudadanos, obligados para pagar dicha deuda a afrontar una mayor presión fiscal o a disfrutar de menores beneficios sociales. En este trabajo se tratará de averiguar si una parte de nuestros problemas financieros nacionales radica en desajustes e ineficiencias de las Administraciones Públicas. Analizando pormenorizadamente las cuentas del Estado, ejemplificando con casos concretos y examinando los textos legales que configuran los presupuestos, se perseguirán causas legales de nuestros problemas financieros. Pese a tener partes de naturaleza económica, pero no por ello este trabajo pierde su enfoque jurídico, pues la Constitución es causa y consecuencia de los Poderes del Estado y límite de todas sus normas. Una vez la sociedad ha configurado y aceptado una constitución, será ésta la que configure la sociedad y por extensión, su economía. Por tanto, pese a abordar un problema de económico, el objetivo último de este trabajo es analizar la Constitución Española (y desarrollo legal) para proponer alternativas de reforma. No se realizará una sesuda revisión de la totalidad de la Constitución Económica, pues se trataría de un trabajo tan inabarcable como disperso, sino de aquellas partes de nuestra norma fundamental que han permitido la inestabilidad económica actual. España debe acometer reformas. No debemos permitirnos como sociedad dejar en herencia a las generaciones venideras un país se endeude y se empobrezca indefinidamente.

This paper owes its inception to the nonconformist idea that the situation of financial over-indebtedness that Spain suffers is not in line with its privileged situation in relation to other countries in intangible aspects such as its culture, its nature, its climatology or its history. Spain has much higher debt and unemployment levels than many of its surrounding countries, despite being a leader in the tourism industry. The recent uncontrolled increase of Spanish public debt has terrible consequences for the Spaniard’s economies. Spaniards must now face greater tax pressure or lower social benefits to repay it. This paper will try to discover which of our economic problems lie in misalignments and inefficiencies of the Public Administrations. Analyzing the state accounts, illustrating with specific cases and scrutinizing the law that shapes the budgetary policies, we will seek the causes of these financial problems. A sound analysis of an economic matter will be carried on, but this will not make it less of a Constitutional Law work. The Constitution is cause and consequence of the the State Powers and the limit of all its legislative texts. Once a society has shaped and accepted a Constitution, it will be this norm that goes on to shape society in reverse. Therefore, in spite of addressing an economic problem, the objective of this work is to analyze the Spanish Constitution and to propose alternatives for its reform. It is not intended to conduct a resounding revision of the whole Economic Constitution, as it would be a task as infinite as it would be disperse. The analysis will be limited to those parts of the Constitution that have allowed such economic distress. Spain must face reforms, as Spaniards should not allow themselves to leave an over-indebted and poorer country to the generations to come.
