La jurisprudencia del TJUE en materia social : impacto en la legislación española

Abstract

El incremento en el número de cuestiones prejudiciales en materia social, y el consiguiente aumento de resoluciones del Tribunal de Justicia de la Unión Europea (TJUE), han provocado un creciente clima de inseguridad jurídica. El presente trabajo tiene por objeto analizar las causas que han motivado el creciente planteamiento de cuestiones prejudiciales y el impacto de las resoluciones del TJUE en la legislación laboral nacional, y plantear una solución a la disparidad interpretativa existente en materia social como consecuencia de los pronunciamientos del TJUE.

The increasing number of reference questions to the European Court of Justice (ECJ) for a preliminary ruling submitted by national courts, and consequently the increasing number of rulings from the ECJ, has led to a climate of legal uncertainty. The present dissertation’s main purpose is to analyze the drivers that had led to the increasing number of references to the ECJ for preliminary rulings and the impact of those rulings in the employment national legislation, and to consider an alternative path that can tackle the existing disparity amongst the employment judge’s interpretations because of ECJ rulings.
