Propuesta de reorganización territorial del Estado tomando como referencia el federalismo alemán

Abstract

Después de 40 años de vigencia de la Constitución Española, son muchas las voces que abogan por una modificación de la misma para adaptarla a los tiempos actuales ya que la realidad en España hoy dista mucho de los tiempos de la Transición. Es por ello que algunas instituciones podrían modificarse a través de enmiendas a la Constitución para hacerlas más efectivas y acordes a nuestros días. El objetivo de este trabajo es hacer una propuesta de reorganización territorial del Estado tomando como referencia el modelo alemán. Para ello se hace un análisis de tres instituciones que podrían ser objeto de modificación: el Senado, el sistema de reparto competencial y el régimen electoral general de ambos países. A través del análisis presentado es posible comprender ambos sistemas y ver cuáles son sus similitudes y los elementos que los diferencian. El primer capítulo está centrado en el país germano, y el segundo en España. En relación al Consejo Federal y al Senado, se examinan tanto su evolución como las competencias que ostentan en cada país así como su funcionamiento y composición internos. Respecto al reparto de competencias, se analiza el sistema de reparto ateniendo a los preceptos constitucionales que presentan la Ley Fundamental de Bonn y la Constitución Española. Por último, se explican los elementos de cada sistema electoral así como las fórmulas utilizadas para la transformación votos-escaños y las particularidades de ambos. Finalmente, en un tono crítico, el tercer capítulo hace una propuesta de modificación examinando los fallos de nuestro sistema actual y determinando la posibilidad de importar elementos del sistema alemán.

After 40 years of validity of the Spanish Constitution, there are many voices that advocate a modification of it to adapt it to the current times as the reality today in Spain is different from the times of the Transition. Because of this, some institutions could be modified through amendments to the Constitution to make them more effective and in line with our days. The aim of this paper is to make a proposal of territorial reorganization of the State taking as reference the German model. To do so, three institutions that could be subject to modification are analyzed: the Senate, the system of distribution of powers and the general electoral regime of both countries. Through the analysis presented it is possible to understand both systems and see what their similarities are differences are. The first chapter is focused on the German country, while the second chapter targets Spain. In relation to the Federal Council and the Senate, both their evolution and the competencies they hold in each country as well as their internal functioning and composition are examined. Regarding the distribution of powers, the distribution system is analyzed according to the constitutional precepts presented by the Fundamental Law of Bonn and the Spanish Constitution. Finally, the elements of each electoral system are explained as well as the formulas used for the votes-seats transformation and the particularities of both. Finally, from a critical perspective, the third chapter makes a proposal examining the failures of our current system and determining the possibility of introducing elements of the German system.
