La política criminal en materia de terrorismo yihadista

Abstract

Los numerosos ataques que han tenido lugar en Occidente desde los atentados del 11-S han provocado que el terrorismo yihadista se presente en la actualidad como una de las preocupaciones principales de cualquier Estado a nivel mundial. El aumento del número de atentados en los últimos cinco años, el incremento del número de integrantes de la organización terrorista conocida como ISIS, y sus formas brutales y sorpresivas de actuación, causando la muerte de cientos de personas, han provocado que los países se hayan visto obligados a actuar. El objetivo de esta investigación consiste en analizar cómo reacciona el legislador español ante esta problemática. Para ello, se sientan las bases de esta nueva forma de terrorismo, se establece qué medidas de política criminal se desempeñan en actualidad y se analizan los distintos artículos en los que se recoge el delito de terrorismo en el Código Penal español, muchos de ellos, fruto de la reforma operada por la LO 2/2015. De la investigación se obtiene que en los últimos años se ha ampliado el concepto de terrorismo, haciendo que el catálogo de delitos de terrorismo sea mayor y que se incriminen actuaciones que, sin siquiera resultar en un atentado, puedan ser calificadas como terrorismo. Todo ello con un objetivo común: frenar el yihadismo.

The numerous attacks that have taken place in the West since the 11-S have caused jihadist terrorism to be considered nowadays as one of the main concerns of any country worldwide. The increase in the number of incidents in the last five years, the growth in the amount of members in the terrorist organization known as ISIS, and their brutal and surprising ways of acting, causing the death of hundreds of people, have forced the countries to act.

The aim of this research is to analyse how the Spanish legislator reacts to this problem. For carrying this out, we have established the basics of this new form of terrorism, explained the Criminal policies that are currently in place and the different articles that regulate the crime of terrorism in the Spanish Criminal Code, many of them, have resulted from the reform operated by LO 2/2015. The study shows that in the past few years the concept of terrorism has been broadened, making the catalogue of terrorism offenses higher and incriminating actions that, without even resulting in an attack, can be classified as terrorism. All of these with a common goal: to stop jihadism.
