El Tribunal Administrativo del Deporte: peculiaridades de un órgano administrativo especial

Abstract

La naturaleza pública del deporte en España es una realidad incuestionable, tanto a nivel estatal como autonómico; con tal objetivo se presenta este Trabajo de Fin de Grado, para mostrar la importancia de la ley, y concretamente del derecho administrativo, en el deporte. Se hace especial referencia a un Órgano Administrativo de reciente creación, el Tribunal Administrativo del Deporte, por su carácter innovador y la repercusión en la actualidad deportiva de sus resoluciones. El estudio de este Tribunal tiene como fin examinar las peculiaridades que se introducen con la nueva normativa que regula su funcionamiento tanto en los aspectos orgánicos como procedimentales.

La constitución de este nuevo tribunal, independiente e imparcial, significa un avance en el sistema, ya que ofrece mayores garantías y transparencia y se adapta a las necesidades jurídicas y deportivas de la actualidad.

A través del estudio de la propia naturaleza del Tribunal y del análisis de sus resoluciones, algunas más polémicas que otras, se darán a conocer al lector las peculiaridades de este órgano que le hacen tan especial, tal y como se apuntaba ya desde el título del trabajo.Con motivo del interés que despierta en la actualidad todo lo relativo al mundo deportivo, y concretamente el fútbol; y, sin dejar de lado la importancia del Derecho Administrativo en su regulación, se ha realizado este Trabajo de Fin de Grado que refleja la gran sintonía que existe entre Derecho y Deporte.

The public nature of sport in Spain is an unquestionable reality, both at the state and regional level; with this objective, this Final Degree Project is presented to show the importance of the law, and specifically of administrative law, in sport. Special reference is made to a recently created Administrative Body, the Administrative Court of Sport (TAD), for its innovative nature and the impact of its resolutions on sports news. The purpose of this Court's study is to examine the peculiarities that are introduced with the new legislation that regulate its operations in both the organic and procedural aspects.

The creation of this Tribunal, independent and impartial, means an advance in the system, since it offers greater guarantees and transparency and adapts to the legal and sporting needs of today.

Through the study of the Court’s nature and the analysis of its resolutions, some more controversial than others, the reader will be informed of the peculiarities of this Court that make it so special, as was already pointed out in the title of the job. Due to the interest that wakes up today everything related to the sport world, and concretely the soccer/football; and, without overlooking the importance of Administrative Law in its regulation, this Final Degree Project that has been carried out, reflects the great harmony that exists between Law and Sport.
