ÉTICA JUDICIAL Y FILOSOFÍA DEL DERECHO HERMENÉUTICA

Abstract

Con este trabajo se pretende llevar a cabo una reflexión en torno a la interpretación judicial defendida por la Filosofía del Derecho Hermenéutica, como alternativa a las anteriores concepciones del Derecho (iusnaturalismo y iuspositivismo). Para ello, partiendo de la síntesis objeto–sujeto que ésta propugna, se ha atendido a los principales aspectos en los que se fundamenta la validez del proceso interpretativo así como el control hermenéutico del juez. La interpretación hermenéutica da cabida a la ética en la resolución de los casos prácticos como consecuencia del protagonismo equitativo del juez en el proceso, que no se limita a la mera aplicación formal de la ley sino que incorpora parte de su entendimiento.

With this work we seek to reflect on the judicial interpretation defended by the Hermeneutics Philosophy of Law as an alternative to the previous conceptions of Law (Natural Law and Legal Positivism). For that, starting from the object-subject synthesis that it defends, we have addressed the main aspects on which the validity of the interpretive process is based as well as the hermeneutic control of the judge. The hermeneutic interpretation includes the ethics in the resolution of the practical cases as a consequence of the equitable limelight of the judge in the process, which is not limited to the simple formal application of the law but incorporates part of its understanding.
