El derecho de uso en los conflictos matrimoniales

Abstract

La vivienda familiar es, junto con la custodia de los hijos, la cuestión más difícil de resolver en los conflictos matrimoniales. De su atribución depende el bienestar futuro de los cónyuges y sus hijos. Su uso y disfrute se puede otorgar por medio de acuerdo entre los cónyuges (la mejor opción) o a través de un procedimiento judicial en el que a menudo los jueces de enfrentan a un dictamen complicado. El propósito de este trabajo es analizar los distintos criterios de atribución del derecho de uso, haciendo hincapié en su caracterización y protección, que aparecen en la ley y, a través de un estudio de la jurisprudencia, demostrar la necesidad urgente de reforma de la legislación española por encontrarse desfasada respecto a la realidad de la sociedad.

The family dwelling is, together with the custody of the children, the most difficult issue to resolve in marital conflicts. The future welfare of the spouses and their children depends on their attribution. Its use and enjoyment can be granted through agreement between the spouses (the best option) or through a judicial procedure in which often the judges face a complicated decision. The aim of this proyect is to analyze the different criteria of attribution of the right of use, emphasizing its characterization and protection, which is regulated in the law and, through a study of jurisprudence, proving the urgent need of the Spanish legislation remodeling due to it is out of date with the reality of society.
