Dialéctica entre Justicia procedimental y Justicia fundacional

Abstract

El estudio gira en torno a la génesis del acto de juzgar. Se trata de encontrar la fuente de la que emana nuestro juicio como personas, nuestra capacidad de discernir el bien del mal, lo correcto de lo erróneo. Se contraponen dos visiones dentro de esta discusión: Jusiticia Procedimental y Justicia Fundacional. La primera defiende que la Justicia se crea a partir del consenso entre individuos, dando lugar a una Justicia cuya fuerza reside en el acuerdo mutuo de todos los intervinientes; mientras que la segunda teoría defiende que hay una capacidad innata para identificar la Justicia intrínseca de los actos que realizamos en la sociedad. Dentro de este marco se desarrollarán ambas tesis, se exponen individualmente y después pasan a ser cotejadas conjuntamente. Así las cosas, la teoría Fundacional pasa a reconocerse como más viable, dando lugar a la pregunta de ¿De dónde emana este sentido de justicia común a todo individuo? Se presenta a Charles Taylor y sus Fuentes del Yo como mayor exponente de una teoría del imperativo moral, que permite edificar una moral basada en la positivización, contraponiéndose a las dinámicas de afirmación por descarte que reinan en los campos legislativos. Por último, se abandona el terreno de las ideas para pasar a proponer líneas biológicas que tratan de explicar, con una base química, la bondad o la maldad de las conductas humanas.

The investigation goes through the act of judging. The purpose is to find the genesis of our judgement as individuals, our ability to distinguish between good and evil, correct or wrong. Two perspectives are opposed within this discussion: Procedural Justice and Foundational Justice. The former defends that Justice is created from a consensus among individuals, deriving in a Justice whose strength is based on the common agreement of all the participants; the latter defends that there is innate ability that identifies the intrinsic Justice of the acts developed among a society. Within this frame, both thesis will be developed, both will be introduced and explained individually. Then, they will be confronted together. As a result, the Foundational theory will be recognized as the most valuable, deriving in the question of Where does this universal sense justice comes from? Charles Taylor will be introduced as the major author of imperative moral theories, which enables us to build a moral based on positive affirmation, in contrast with the negative dynamics of affirming by discard that reigns in the legislative fields. Last, abstract fields will be abandoned to propose biological paths that try to explain, basing on chemicals, the good or evil human conducts.
