TICs y Contrato de Trabajo: facultades empresariales de vigilancia informática

Abstract

Este trabajo trata de esclarecer los límites del control laboral llevado a cabo mediante nuevas tecnologías, realizando una labor de concreción mediante el estudio de jurisprudencia y doctrina, así como un análisis de los derechos afectados en la relación laboral, haciendo especial énfasis en los derechos fundamentales del trabajador como límite a la potestad de control del empresario. A su vez se intenta conceptualizar el alcance de los derechos de las partes, llevando a cabo un análisis de su evolución histórica y el alcance de las facultades que engloban bajo su ámbito objetivo. Se realiza en una investigación individualizada de los métodos tecnológicos aplicados al entorno laboral, y como éstos lo han modificado, así como los nuevos métodos de control derivados de la aparición de las TICS. Por último se realiza una síntesis de las normas jurisprudenciales y regulaciones aplicables, estudiando su evolución hasta nuestros días.

This work tries to clarify the limits of labour control carried out by means of new technologies, carrying out a work of concreteness through the study of jurisprudence and doctrine, as well as an analysis of the rights affected in the labour relationship, with special emphasis on the fundamental rights of the worker as a limit to the employer's power of control. At the same time, an attempt is made to conceptualize the scope of the rights of the parties, carrying out an analysis of their historical evolution and the scope of the faculties that they encompass under their objective scope. It is carried out in an individualized investigation of the technological methods applied to the work environment, and how these have modified it, as well as the new control methods derived from the appearance of ICTs. Finally, a synthesis of the applicable jurisprudential norms and regulations is made, studying their evolution up to the present day.
