La identidad de género a la luz de la Convención de los Derechos del Niño

Abstract

Este texto viene a ayudar a una reflexión serena sobre los derechos de los niños transexuales desde la perspectiva de la Convención de los Derechos del Niño de 1989. Creo que buscar el interés superior del niño en cada decisión que debe adoptarse y, por tanto, evaluar los distintos derechos implicados, atender a los criterios legales que facilitan esa evaluación y ponderar los elementos que concurren en la situación no sólo resulta conveniente sino que se trata de un imperativo que nace del propio texto convencional.

This text helps to calmly reflect on the rights of transgender children from the perspective of the 1989 Convention on the Rights of the Child. I believe that the best interest of the child should be sought in every decision that must be adopted and, therefore, evaluated the different rights involved, attending to the legal criteria that facilitate this evaluation and weighing the elements that concur in the situation is not only convenient but it is an imperative that arises from the conventional text itself.
