El interés superior del menor migrante: El caso de Tabitha.

Abstract

El presente trabajo de investigación analiza estrategias de integración en favor de un segmento específico del fenómeno migratorio. Nuestro objeto de atención son los menores de edad no acompañados, los cuales pasan solos las fronteras europeas en búsqueda de una vida mejor. Este trabajo examina las diferentes funciones normativas del interés superior del niño, como se expresa en la Convención sobre los Derechos del niño (1989). La consideración de las normas internacionales nos permite afirmar que el interés superior del niño tiene que ser entendido como un conjunto de derechos fundamentales reconocidos por la mencionada Convención.

The present research work analyzes integration strategies in favor of a specific segment of the migratory phenomenon. Our focus is on unaccompanied minors, who pass through European borders alone in search of a better life. This paper examines the different normative functions of the best interests of the child, as expressed in the Convention on the Rights of the Child (1989). Consideration of international standards allows us to affirm that the best interests of the child must be understood as a set of fundamental rights recognized by the aforementioned Convention.
