Ucrania : la península de Crimea y su encaje actual en el panorama de la sociedad internacional

Abstract

La intención de este trabajo es aportar claridad a una realidad actual en terreno exsoviético. El trabajo se centra en las relaciones entre Rusia, Ucrania y Crimea desde la historia más reciente, concluyendo con el estudio sobre la anexión de la península de Crimea por parte de Rusia a partir de la celebración de un referéndum, para ciertos expertos y la gran mayoría del espectro internacional, ilegal e ilegítimo. Remontándonos a la independencia de Ucrania en 1990, donde Rusia empieza a ver peligrar su influencia en la zona y la inevitable caída de su imperio, su distanciamiento con la antigua república exsoviética que consecuentemente se acerca cada vez más a la Unión Europea; la anexión de Crimea para con Rusia supone un golpe bajo a Ucrania, anclada a las raíces de derecho internacional que no han sido respetadas por Rusia. Siendo considerada como una victoria de Vladimir Putin y un retroceso en las relaciones entre las dos potencias, que desde la crisis de 2013 no han mejorado, ha de denotarse que este suceso también afecta al contexto de las relaciones diplomáticas. El objetivo central del trabajo es el análisis exhaustivo desde la historia, la diplomacia, las relaciones entre los países, el ordenamiento jurídico internacional y el Derecho Internacional de los sucesos que llevaron a la secesión de Crimea y cómo ésta encaja en el plano internacional. Por ello, se procederá a estudiar desde los antecedentes y el desarrollo de las crisis entre Rusia, Ucrania y Crimea, el análisis del referéndum del pueblo crimeo, centrando el debate desde una perspectiva democrático – jurídico – y sobre todo internacional en el contexto de un mundo multipolar cada vez más dividido entre Oriente y Occidente. Se concluirá con una cuestión abierta a debate: el nuevo imperialismo ruso. ¿Acaso Crimea ha logrado su anexión a Rusia por y para el pueblo o se ha debido a la actuación fraudulenta de los intereses rusos, consistentes en expandir su área de influencia?

The intention of this work is to bring clarity to a historical and current reality on Soviet soil. The work focuses on the relations between Russia, Ukraine and the Crimea since the most recent history, concluding with the study on the annexation of the Crimea peninsula by Russia from the holding of a referendum, for certain experts and the vast majority of the international spectrum, illegal, and for others, legal. Travelling back in time to the independence of Ukraine in 1990, where Russia first saw its influence in the area endangered and the unavoidable fall of its empire, as well as the longing distance from the former soviet Republic, which consequently approached the European Union, the annexation of Crimea to Russia represents a low blow to Ukraine, anchored to the principles contained in International Law which have not been respected by Russia. Considered such as a victory of Vladimir Putin and a setback in relations between the two powers, which since the crisis of 2013 have not improved, thus, it should be noted that it also affects the context of diplomatic relations. The central objective of the work is the exhaustive analysis from history, diplomacy, the relations between countries, the international legal order and International Law of the events that led to the secession of the Crimea peninsula and how it fits into the international plane. Therefore, the study will proceed through the background and development of the crisis in between Russia, Ukraine and Crimea to tackle the analysis of the referendum of the Crimean, centring the debate from a democratic - legal - and above all international perspective in the context of a multipolar world increasingly divided between East and West. It will conclude with an open issue for debate: the new Russian imperialism. Has Crimea achieved its annexion from Ukraine and to Russia for and by the sake of the people or by fraudulent action of Russian’s interests, consistent on expanding Russia’s area of influence?
