dc.description.abstract | En este trabajo se va a estudiar el delito de fraude contra la Hacienda Pública contenido en el artículo 305 y 305 bis del C.P. Se determinará cual es la diferencia existente entre el delito y la infracción tributaria. La responsabilidad penal del sujeto que incurra en el delito y el bien jurídico protegido. Posteriormente, el trabajo se centrará en el análisis de la jurisprudencia existente respecto a este delito en España, en el ámbito de los deportistas. Se analizarán algunas de las sentencias más destacadas de los últimos tiempos. Para ello, antes de este análisis, se explicarán las diferentes vías a través de las cuales estos deportistas cometen el fraude utilizando paraísos fiscales. También se mencionarán las medidas existentes para lograr evitar estas conductas. Por último, se examinará la responsabilidad penal en la que incurren los asesores fiscales, que son quienes diseñan los complejos sistemas de defraudación de estos deportistas y las medidas puestas en marcha por la Unión Europea en los últimos tiempos, para evitar estas prácticas por parte de los asesores. | es-ES |
dc.description.abstract | This paper will study the crime of tax fraud contained in Articles 305 and 305 bis of the Criminal Code. The difference between the crime and the tax offense will be determined. The criminal responsibility of the subject who incurs in the crime and the protected legal property. Subsequently, the work will focus on the analysis of existing jurisprudence regarding this crime in Spain, in the field of athletes. We will analyze some of the most outstanding judgments of recent times. To this end, before this analysis, the different ways in which these sportsmen and women commit fraud using tax havens will be explained. Existing measures to prevent these behaviors will also be mentioned. Finally, it will examine the criminal liability incurred by tax advisors, who are the ones who design the complex systems of fraud of these athletes and the measures implemented by the European Union in recent times, to prevent these practices by the advisors. | en-GB |
