La gestación subrogada : el interés superior del niño

Abstract

El presente estudio trata de profundizar en uno de los conflictos más controvertidos hoy en día, es decir la gestación subrogada a la luz del principio del interés superior del niño. En concreto, se plantean las implicaciones legales de esta técnica de reproducción asistida, en relación con el sujeto más vulnerable, es decir el niño. Asimismo, se delimita la temática a través del iter jurisprudencial más relevante y el marco normativo vigente.

Si bien, la ausencia de una regulación específica de los efectos de la gestación por sustitución llevada a cabo en el extranjero ha dado lugar a una problemática muy reciente en cuanto a la filiación de los niños en cuestión, entre otras muchas problemáticas no profundizadas anteriormente.

Por consiguiente, este estudio pretende analizar desde nuestra Constitución, las diversas valoraciones relativas a la mencionada técnica, tratando de alcanzar posturas conciliadoras en un tema de suma complejidad. Con ese fin, se plantean una serie de conclusiones que tratan de dar respuesta a la temática en cuestión, para proteger y garantizar el interés superior del niño.

This study attempts to delve deeper into one of the most controversial conflicts today, namely the surrogacy in the light of the principle of the best interests of the child. Specifically, the legal implications of the aforementioned assisted reproduction technique are considered in relation to the most vulnerable subject, that is to say the child. Likewise, the topic is delimited through the most relevant jurisprudential cases and the current normative framework.

However, the absence of a specific regulation concerning the effects of gestation by substitution carried out abroad has given rise to a very recent problem regarding the filiation of the children in question, among many other problems not previously studied.

Consequently, this study seeks to analyze from our Constitution the various valuations relating to the aforementioned technique, trying to reach conciliatory positions on an issue of great complexity. To this end, a series of conclusions are presented that attempt to respond to the issue in question in order to protect and guarantee the best interests of the child.
