Aspectos constitucionales del internamiento involuntario urgente de pacientes psiquiátricos y alternativas: el tratamiento ambulatorio

Abstract

Este trabajo tiene por objeto el estudio del régimen jurídico aplicable a los pacientes psiquiátricos en España, centrándose en particular en el procedimiento de internamiento y en las posibilidades para la incorporación al ordenamiento jurídico de tratamientos menos lesivos para los derechos del enfermo. Con este fin, el estudio comienza mostrando el panorama regulatorio relativo al internamiento involuntario, para, a continuación, efectuar un análisis sobre su problemática jurídica. Posteriormente, se efectúa una propuesta de política legislativa al respecto, dedicando el último apartado a la exposición del novedoso tratamiento ambulatorio involuntario (TAI). El trabajo finaliza con las conclusiones obtenidas a lo largo del análisis.

The purpose of this work is to study the legal regime applicable to psychiatric patients in Spain, focusing in particular on the confinement procedure and the possibilities for the incorporation into the legal system of treatments less harmful to the rights of the patient. To this end, the study begins by showing the regulatory framework relating to involuntary confinement, followed by an analysis of its legal problems. Subsequently, a legislative policy proposal is made in this respect, dedicating the last section to the exposition of the novel involuntary ambulatory treatment. The work finalizes with the conclusions obtained throughout the analysis.
