Estudio del problema de las licencias VTC y los taxis desde la perspectiva del Derecho Administrativo

Abstract

El conflicto entre los VTC y los Taxis venía fraguándose desde hace mucho tiempo, pero ha sido ahora, durante estos últimos años, cuando se han puesto de manifiesto los problemas sociales y políticos. A medida que la tensión entre ambas modalidades de transporte crece, conseguir alcanzar una solución conciliadora parece quedar cada día más lejos. La falta de aplicabilidad práctica de las normas, la incoherencia legislativa, y la celeridad en la toma de decisiones han sido las notas características que han configurado el problema social existente. Este problema tiene su único origen en una descoordinada e incongruente política legislativa, que ha venido, a su vez, muy determinada por decisiones políticas. Este trabajo pretende realizar un análisis de la problemática existente, a través, del estudio las reformas legislativas que se han llevado a cabo. Asimismo, se pretende realizar igualmente, un análisis jurisprudencial de estas reformas, para con ello poner en sintonía la situación legislativa con su reflejo en la realidad práctica y el problema social generado entre los VTC y los Taxis. Por último, se aborda la legalidad de las soluciones que se están proponiendo y las que ya se han comenzado a implementar, para dar una salida definitiva a este conflicto, sin que a día de hoy se haya encontrado ninguna solución que sea ajustada a derecho o económicamente viable.

The conflict between the VTCs and Taxis has been going on for a long time, but it is now, in recent years, that social and political problems have become apparent. As the tension between the two modes of transport grows, reaching a conciliatory solution seems to get further and further each day. The lack of practical applicability of the rules, legislative incoherence, and speed in decision-making have been the characteristic features that have shaped the existing social problem. This problem has its only origin in an uncoordinated and incongruous legislative policy, which in turn has been very much determined by political decisions. The aim of this work is to analyze the existing problem by studying the legislative reforms that have been carried out. Likewise, it is also intended to carry out a jurisprudential analysis of these reforms, in order to tune the legislative situation with its reflection in the practical reality and the social problem generated between the VTC and the Taxis. Finally, it deals with the legality of the solutions that are being proposed and those that have already begun to implement, to give a definitive solution to this conflict, without to date no solution has been found that is adjusted to law or economically viable.
