El futuro del trabajo

Abstract

El presente estudio versa sobre el futuro del trabajo y se puede desglosar en dos partes diferenciadas. En primer lugar, se han identificado las nuevas formas de trabajar, de dar empleo y de organización empresarial, permitiendo su análisis avisar las realidades, retos y oportunidades que aguarda el futuro del trabajo. La mayor parte de las nuevas realidades enfrentan a las dos modalidades de empleo por excelencia: el trabajo asalariado y trabajo autónomo. Mediante un estudio y análisis de la configuración actual del Derecho del Trabajo, del concepto de contrato de trabajo del Estatuto de los Trabajadores y doctrina laboralista, se ha buscado lograr reflexiones y conclusiones de interés que permitan lograr una propuesta de acogida jurídica fundada acerca de qué vía sería la mejor y/o más adecuada para solventar e incorporar los retos del futuro en el marco jurídico español, si el contrato de trabajo o el trabajo autónomo.

The present study deals with the future of word and can be divided in two distinct parts. First of all, new ways of working, employment and business organization have been identified, allowing its analysis foresee the realities, challenges and opportunities that the work awaits. The majority of the new realities have demonstrated to confront the two modalities of employment par excellence: salaried work and self-employment. Through a studio and analysis of the current configuration of the Spanish Labour Law, the concept of contract of employment and labour doctrine, it has been sought to achieve concluding thoughts in order to make a founded proposition about which legal framework would serve as better and/or more adequate path to solve and incorporate the challenges of the future of work, if the contract of employment or the contract of self-employment.
