La responsabilidad civil en Blockchain

Abstract

La revolución de Blockchain o como se dice popularmente, el hype, comienza hace apenas un par de años, a principios de 2017. El interés generalizado en la entrada disruptiva de esta tecnología en el ciber-espacio ha levantado tantas alabanzas como críticas en la opinión de expertos y no tan expertos. En mi caso, miembro honorifico del segundo grupo de no-expertos, he querido asumir el desafío y meterme de lleno en este proyecto, con el objetivo de entender qué es Blockchain y qué opina el Derecho de esta tecnología. Al fin y al cabo, algo significativo y sustancial debe estar pasando para que nombres con tanto peso como American Express Company, Facebook, JP Morgan, IBM, Amazon y un larguísimo etcétera no hayan dudado en formar parte de esta esfera tecnológica. A través de este trabajo pretendo analizar desde los conceptos más básicos de Blockchain hasta la cuestión principal, que es lo que más llamó mi atención durante la investigación: la responsabilidad civil. Así, comienzo respondiendo a las principales preguntas: qué es, cómo funciona y quién es quién. Tras este capítulo, introduciré la responsabilidad civil, para posteriormente exponer los riesgos que la generan y por último, centrar todo lo anterior en las redes públicas permisionadas, modelo que he escogido por ser la principal opción en el ámbito mercantil. Aun siendo un tema extremadamente técnico que, en muchas ocasiones, me ha resultado complejo llegar a la plena comprensión, lo cierto es que esta tecnología necesita el Derecho para seguir creciendo, ya que requiere de una regulación urgente. Concretamente la responsabilidad civil en este tipo de redes todavía no está regulada prácticamente en ningún país del mundo, con salvedades (muy criticadas, por cierto). He aquí el motivo por el cual he decidido escoger un tipo de red concreta y exponer, desde nuestro ordenamiento jurídico, el régimen de responsabilidad que siguen las redes Blockchain desde distintos puntos de vista. Con todo esto, pretendo mostrar al lector la versión jurídica de una tecnología tan compleja como es el Blockchain, revelar la importancia creciente de la misma y la extrema y urgente necesidad de una regulación específica tanto a nivel estatal como europeo.

The revolution of Blockchain, or popularly said: the hype, merely started two years ago, in the beginning of 2017. The general interest in the disruptive entrance of this technology in the cyberspace has raised as many praises as critics within the expert and not-so-expert circles. In my case, obviously an honorific member of the second group of not-so-experts, I wanted to accept the challenge and submerge myself in this project, with the solely objective of understanding what is Blockchain and what Law has to do with this technology. After all, something significant and substantial has to be happening so that names that sound as good as American Express Company, Facebook, JP Morgan, IBM, Amazon and a very long etcetera have not hesitated to be part of this complex world. Through this work I intend to analyze from the most basic concepts of Blockchain to the main issue, which is the topic that caught my attention during the investigation: civil liability. Thus, I start this essay by answering the main questions: what it is, how it works and who is who. After this chapter, I will introduce civil liability, to later expose the risks that generate it and finally, bringing all the above to the permissioned public ledgers, model that I have chosen for being the main option in the commercial field. Being an extremely technical issue that, on many occasions, it has been difficult for me to understand, the truth is that this technology needs the Law since it requires urgent regulation. Specifically, civil liability in this type of networks is still not regulated practically anywhere in the world, with reservations (very criticized, by the way). Here is the reason why I have decided to choose a specific type of network and analyze their regime of responsibility from within our legal system. With all this, I intend to show the reader the legal version of a technology as complex as the Blockchain, reveal the increasing importance of it and the extreme and urgent need for specific regulation both at the state and European level.
