La justificación político-criminal de la prisión permanente revisable en los delitos de terrorismo

Abstract

La actualidad y el cuestionable fundamento de la prisión permanente revisable hace que resulte interesante y novedoso realizar una investigación sobre su justificación, que tanto debate está generando en la sociedad actual, no solo a nivel político o de doctrina legal, sino también al nivel profano del ciudadano medio. Por otro lado, el hecho de dirigir el foco hacia la justificación de esta institución penal (una vez establecido su fundamento) en relación a un delito concreto, tan escabroso y delicado como es el terrorismo, supone analizar, desde un punto de vista actual, una cuestión como el terrorismo, que ha convivido con la humanidad prácticamente toda su historia, en diversas manifestaciones y vertientes y que tantas discusiones morales está generando. Por tanto, el propósito general de esta investigación consiste en, tras establecer un fundamento de la institución penal de la prisión permanente revisable a través de una argumentación general de su justificación, dirigir la mirada a una posible concreción del debate de su justificación político-criminal de una manera más focalizada a uno de los delitos para los que está prevista: el asesinato terrorista.

The current state of affairs and the questionable foundation of the reviewable permanent prison make it interesting and novel to carry out an investigation into its justification, which is generating so much debate in today's society, not only at a political or legal doctrine stage, but also at the profane stage of the average citizen. On the other hand, the fact of directing the focus towards the justification of this penal institution (once its foundation has been established) in relation to a specific crime, as scabrous and delicate as terrorism is, implies analyzing, from a current point of view, an issue such as terrorism, which has coexisted with humanity practically all of its history, in diverse manifestations and slopes, and which is generating so many moral discussions. Therefore, the general purpose of this investigation consists of, after establishing a foundation of the penal institution of the reviewable permanent prison through a general argumentation of its justification, directing the gaze to a possible concretion of the debate of its political-criminal justification in a more focused way to one of the crimes for which it is foreseen: the terrorist murder.
