La responsabilidad civil extracontractual de los actos del menor maduro en los ámbitos civil, penal y administrativo

Abstract

La responsabilidad civil extracontractual del menor maduro es un tema que se ha llevado a debate mucho a lo largo de los años, ha sido objeto tanto de diversas reformas legislativas como interpretaciones judiciales. El trabajo realiza una comparativa de las distintas regulaciones de la responsabilidad civil extracontractual por los actos del menor maduro en los ámbitos civil, penal y administrativo dentro del Derecho Español, además también ahonda en el concepto de menor maduro y se analiza la madurez e imputabilidad del menor de edad. Se destacará la trascendencia de la capacidad de obrar del menor y su capacidad de entendimiento de las consecuencias de sus acciones, además de la posible responsabilidad de sus padres o representantes legales. Asimismo, se hará referencia a los criterios doctrinales y tendencias jurisprudenciales más relevantes y actuales en cuanto al estado de la cuestión, y se expondrán unas conclusiones generales sobre el tema tratado.

The non-contractual civil liability of the mature minor is a subject that has been debated a lot over the years; it has been subject to various legislative reforms as well as judicial interpretations. This paper makes a comparison of the different regulations of non-contractual civil liability for the acts of the mature minor in the civil, criminal and administrative fields within the Spanish Law; in addition it also delves into the concept of mature minor and analyzes the maturity and accountability of the minor. The transcendence of the minor's ability to act and their ability to understand the consequences of their actions will be highlighted, as well as the possible responsibility of their parents or legal representatives. Likewise, reference will be made to the most relevant and current doctrinal criteria and jurisprudential trends regarding the state of the matter, and general conclusions will be presented on the subject under discussion.
