Los derechos de los menores ante una ruptura matrimonial conflictiva

Abstract

El modelo tradicional de familia ha sufrido grandes cambios en los últimos años existiendo en las últimas décadas un gran incremento de separaciones y divorcios. Es importante garantizar el derecho fundamental de los menores a relacionarse adecuadamente con sus progenitores manteniendo todos sus vínculos. La finalidad de este trabajo final de grado, el cual aborda los derechos de los menores en las rupturas matrimoniales conflictivas, nos ayuda a realizar una aproximación del tema permitiendo entender y aprehender los conceptos básicos relacionados con los derechos de los menores. También nos facilitará aproximarnos y conocer los mecanismos de protección que existen actualmente en materia de menores, introduciéndonos especialmente en la protección de los menores en circunstancias intrafamiliares de las que principalmente devenga un conflicto. Las rupturas matrimoniales con carácter conflictivo, provocan abundantes daños colaterales, pero en especial afectan considerablemente a los hijos del matrimonio. Analizaremos como padece el menor en estas situaciones y las medidas que se deberían de llevar a cabo para atenuar y apaciguar la duración de esta etapa del proceso. Examinaremos los derechos que ostenta el menor en estos procesos, por un lado durante el proceso, y por otro lado tras él, y los analizaremos para un absoluto entendimiento y cumplimiento de su protección en procesos futuros.

The traditional model of family has suffered various changes in the last few years, existing in the last decade an increase y the number of separations and divorces. It’s important to guarantee the fundamental right of the minors to relate properly with their progenitors, maintaining all of their familiar links. The aim of the present work, which deals with the rights of minors in situations of conflictive ruptures of their parent’s relationship, helps us to carry out a comprehensive approach of the issue helping to recognize and understand the basic ideas and concepts associated to the minors rights and its protection. It that will also facilitate us to the alignment and appreciation of protection mechanisms that currently exist in the rules of minor’s protection during and after the judicial process This circumstance, such as marital breakdowns where conflict plays an important role, provokes many collateral damages that the children of the couple suffer considerably. We will evaluate how the minor’s suffer in these situations and the measures that should be adopted to attenuate the duration and consequences of this type of process. We will also examine the rights that hold the minors in this type of proceedings for an absolute understanding and accomplishment of their protection in future proceedings.
