LA REGULACIÓN DE LAS VTC EN ESPAÑA

Abstract

La evolución de la tecnología supone un cambio en las exigencias que demandan los consumidores, quienes ven como su día a día puede ser, mediante el uso de estas, más sencillo, más rápido y más cómodo. Es por esta razón por la que las empresas han de adaptarse e integrar en sus productos y servicios el uso de las mismas. Este trabajo tiene como objetivo hacer comprender al lector que la solución al conflicto entre los vehículos de transporte con conductor y los taxis está destinado a resolverse a través de la liberalización del sector. Su justificación tiene como base considerar que pretender seguir manteniendo un tipo de servicio, como es el de transporte llevado a cabo por los taxis tal y como los conocemos, sin que integren el uso de la tecnología disponible, supone un atraso y una pérdida de bienestar para la sociedad en su conjunto. A través de un análisis pormenorizado de la situación actual, la legislación y jurisprudencia en torno al tema, así como otros temas de gran importancia como el interés económico que se esconde detrás del mercado secundario de licencias y el reparto de las mismas, podremos ir descartando las distintas alternativas hasta llegar a la que creemos es la que requiere el conflicto.

The development of technology means a change in the requirements demanded by consumers, who see how their day-to-day can be, through the use of these, simpler, faster and more user-friendly. Because of this, companies have to adapt and integrate into their products and services the use of them. The objective of this paper is to make the reader understand that the solution to the conflict between VTC and taxis is destined to be solved through the liberalization of the sector. Its explanation is based on the fact that pretending to maintain a type of service, such as taxis, as we know them, without integrating the use of available technology, represents a backwardness and a loss of welfare for society. Through a detailed analysis of the current situation, legislation and jurisprudence on the subject, as well as other issues of great importance such as the economic interest behind the secondary licensing market and the distribution of them, we can discard the different alternatives until we reach what we believe is what the conflict requires.
