La introducción del "sexting" en el Código Penal español

Abstract

El objeto del presente trabajo de investigación es analizar la introducción y regulación del comúnmente conocido como delito de sexting en el ordenamiento jurídico español. La inclusión del nuevo tipo delictivo -que se encuadra en el apartado séptimo del artículo 197 del Código Penal- fue motivada por la reforma de la legislación penal del año 2015. El apartado séptimo del citado artículo regula otras conductas distintas al sexting que también lesionan el bien jurídico de la intimidad. No obstante, a los efectos del presente trabajo de investigación, solo se analizará la conducta consistente en el revenge porn, así como también, los debates doctrinales y jurisprudenciales que se han suscitado a raíz de la inclusión ex novo de este tipo delictivo.

The aim of this paper is to address and analyze the revision of the Spanish Criminal Code and, in particular, the inclusion of article 197 subparagraph 7. The introduction of the criminal offence of sexting took place within a more general framework of reforms that revisited and reshaped the Spanish Criminal Code in 2015. Article 197.7 includes many other wrongdoings that have no relation whatsoever to the offence consisting in sending away the sexual images and videos that one has obtained from the main character portrayed in those exact pictures and videos. All the criminal behaviors contained in the cited article infringe the right to privacy. Nevertheless, throughout this research paper the offence consisting in sending away those sexual images and videos will be analyzed. Furthermore, it will also look at the jurisprudential and doctrinal opinion towards the inclusion of this new felony.
