Los Contratos Inteligentes: un nuevo reto para el Derecho Internacional Privado

Abstract

El presente trabajo trata de proporcionar una visión completa y comprensible de la novedosa figura de contratos inteligentes, su papel en el tráfico jurídico internacional, y de cómo se han de abordar las posibles controversias que surjan en este ámbito desde el punto de vista del derecho Internacional Privado. A tenor de lo anterior, se procederá primero al estudio de la figura y usos de los contratos inteligentes, comparándolos con los tradicionales para su mejor comprensión. Y a continuación se tratará qué ocurre cuando surge una disputa en un contrato inteligente con elementos internacionales, analizando los posibles foros de competencia y normativa aplicable a los que se habrá de someter la relación jurídica, y las especialidades que, debido al tipo de contracto, se deberán observar en ellas.

The present paper tries to provide a complete an understandable vision of the novel figure of smart contracts, their role in international trade, and how to approach possible discrepancies in the contractual relation from an International Private Law point of view. In accordance with the above, it will first be introduced an analysis of the figure smart contracts, contrasting them with traditional contracts with the aim of providing a better understanding of the matter. And consecutively we will face the matter of contractual disputes in international smart contracts, analysing the possible forums of jurisdiction applicable to the relation and the determination of the law that must govern the contractual relationship, assessing the singularities that due to this contractual type, must be observed when clarifying this matters.
