Fundamentación filosófica y moral del Estado moderno

Abstract

Dado el reciente debate surgido a raíz de los nacionalismos sobre la validez y el reconocimiento de la constitución desde un punto de vista de su contenido material, me ha parecido interesante realizar un análisis sobre la base moral que tiene el estado y su reflejo en la norma fundamental que lo regula. Para ello, he realizado un estudio basado en la evolución histórica del derecho, la organización política y su contexto ideológico o moral; a partir del cual se ha llegado a la situación actual. Así, he partido de la premisa de que cuando estos tres elementos no se corresponden, se producen fricciones en el seno de la sociedad que inducen a un cambio. El eje cronológico lo he comenzado en el siglo XVI, cuando se produce una crisis interna de la Iglesia. Esto dio lugar al caldo de cultivo necesario para una transformación de la sociedad y del pensamiento, pasando de una organización basada en la religión y en un plan divino a otra basada en la propia naturaleza y las necesidades del ser humano; y, por tanto, construyendo los elementos del estado, tal y como está organizado hoy. Finalmente, he realizado un análisis de las preocupaciones sociales y morales de hoy, y lo he proyectado sobre la organización del estado y del derecho, basándome en todos los conflictos anteriormente estudiados.

Given the recent debate arising from the nationalisms on the validity and recognition of the constitution from a point of view of its material content, I found it interesting to make an analysis on the moral basis of the state and its reflection in the fundamental law that regulates it. For this, I have made a study based on the historical evolution of law, political organization and its ideological or moral context; from which the current situation has been reached. Thus, I have started from the premise that when these three elements do not correspond, frictions occur within the society and induce a change. The time lapse starts in the sixteenth century, when there is an internal crisis of the Church. This gave rise to the breeding ground necessary for a transformation of society and thought, moving from an organization based on religion and a divine plan to another based on the nature and needs of the human being; and, therefore, constructing the elements of the state, as it is organized today. Finally, I have made an analysis of the social and moral concerns of today, and I have projected them on the organization of the state and the law, based on all the conflicts previously studied.
