Una aproximación a "Free Culture" de Lawrence Lessig. ¿Cómo pueden convivir los derechos de autor y la “cultura libre” en Internet?

Abstract

Internet ha supuesto un cambio de paradigma a la hora de difundir y democratizar la cultura. Esta nueva realidad ha favorecido enormemente a los usuarios, pero ha puesto en jaque la protección de los derechos de propiedad intelectual a nivel mundial. El presente trabajo estudia la compleja y debatida relación entre preservar los derechos de autor y respetar la libertad de contenidos en la red. Partiendo de la obra Free Culture de Lawrence Lessig, la cual ha dado lugar a todo un movimiento en Estados Unidos, se analizará la filosofía de la cultura libre que prima en Internet y la filosofía de la legislación que trata de proteger a los autores. La fuerte implantación de ambos sistemas hace que tengamos que revisitar la vieja pugna entre libertad y propiedad, aunque sea esta vez en un nuevo ámbito: la red.

Internet has implied a paradigm shift in the way culture has been disseminated and democratized. This new reality has greatly favored users, but it has also jeopardized the protection of intellectual property rights worldwide. This Final Degree Project studies the complex and discussed relationship between preserving the author’s rights and the freedom of content in the network. Analyzing Lawrence Lessig's Free Culture, which has given rise to a whole movement in the United States, this paper will study the free culture’s philosophy, which prevails on the Internet, and the philosophy of the legislation, that seeks to protect authors. The strong implementation of both systems enhances the need of revisiting the old struggle between freedom and property, but in a new field this time: the network.
