Análisis institucional y jurídico de la Casa de Contratación de Sevilla

Abstract

El 20 de enero del año 1503, los Reyes Católicos fundan la Casa de Contratación de Sevilla. Esta institución fue la encargada de administrar y gestionar el comercio con el Nuevo Mundo, llegando a ser una de los organismos gubernamentales más importantes del mundo. La Casa de la Contratación funcionó como órgano de control del tráfico ultramarino, fue la oficina de apresto y de organización de flotas, la tesorería que donde se depositaban todas las riquezas obtenidas de las Indias, llevaba a cabo las funciones que le correspondían como departamento de emigración, se encargó de la contabilización de todas las cifras que manejó esta institución a lo largo de su historia, administraba justicia a través de su propio tribunal y se convirtió en un centro de investigación científica de primer nivel europeo. En un primer momento, se decidió fundar esta Institución en la ciudad de Sevilla por las características geográficas de la capital hispalense y por ser la ciudad con mayor población del Reino de Castilla. Sin embargo, tras más de 200 años instalada en Sevilla se decidió que lo mejor era trasladas la Casa de la Contratación a la ciudad de Cádiz en el 12 de mayo de 1717. Finalmente, el rey Carlos IV decreta el fin de la Casa de la Contratación el 18 de julio de 1790 y a día de hoy, toda la documentación sobre esta institución que funcionó durante casi trescientos años se encuentra en el Archivo de las Indias.

On January 20, 1503, the Catholic Monarchs founded the Casa de Contratación in Seville. This institution was responsible for administering and managing trade with the New World, becoming one of the most important government agencies in the world. The Casa de la Contratación functioned as an organ of control of overseas traffic, it was the office of preparation and organization of fleets, the treasury where all the wealth obtained from the Indies was deposited, it carried out the functions that corresponded to it as an emigration department, it was in charge of the accounting of all the figures that this institution handled throughout its history, it administered justice through its own court and it became a scientific research center of the first European level. At first, it was decided to found this Institution in the city of Seville because of the geographical characteristics of the capital of Seville and because it was the city with the largest population of the Kingdom of Castile. However, after more than 200 years installed in Seville it was decided that the best was to move the Casa de la Contratación to the city of Cadiz on May 12, 1717. Finally, King Charles IV decreed the end of the Casa de la Contratación on 18 July 1790 and today, all documentation on this institution that operated for almost three hundred years is in the Archives of the Indies.
