Comprensión y sentido hermenéutico en la concepción iusfilosófica

Abstract

El propósito del presente trabajo es analizar el sentido, el concepto fundamental de la Hermenéutica. Para ello, se expondrán en primer lugar sus rasgos más característicos y las implicaciones que tiene su reconocimiento en la práctica, especialmente relevantes respecto a la aplicación del derecho por parte del juez. Posteriormente, se comparará la propuesta filosófica de la Hermenéutica con las dos corrientes de pensamiento jurídico que tradicionalmente han tenido mayor influencia, el Iusnaturalismo y el Iuspositivismo, con la finalidad de mostrar la gran aportación que realiza a la reflexión jurídica mediante su defensa del sentido.

The purpose of the present work is to analyse the meaning, the fundamental concept of Hermeneutics. For it, firstly there will be explained its more characteristic features and the implications which its recognition has in the practice, specially relevant regarding the application of law by the judge. Afterwards, the Hermeneutics philosophical proposal will be compared with the schools of legal thought that have traditionally had larger influence, Natural Law and Legal Positivism, with the aim of showing the great contribution that it makes to legal reflection through its defence of the meaning.
