Retos y desafíos del nuevo modelo de financiación autonómica: especial referencia a los aspectos tributarios

Abstract

La promulgación de la Constitución de 1978 y la Ley Orgánica 8/1980 de Financiación de las Comunidades Autónomas supuso la creación del Estado Autonómico en España cuyas bases son la organización territorial estructurada en municipios, provincias y Comunidades Autónomas. Desde entonces, España ha sufrido un proceso de descentralización con la aprobación y reforma de los Estatutos de Autonomía, así como con su integración en Europa, ganando cada vez mayor autonomía financiera las CCAA en detrimento del Estado. Sin embargo, con la Crisis financiera de 2008 este sistema se tambaleó, exigiendo reformas que tuvieron lugar en 2009 y que, sin embargo, no lograron satisfacer las demandas de las administraciones públicas autonómicas ni las necesidades que el propio sistema de financiación autonómica reclamaba. De esta forma y de acuerdo con el Informe de la Comisión de Expertos de 2017 para la reforma del sistema financiero hoy nos encontramos con un sistema que adolece de problemas de suficiencia financiera, equidad y eficiencia y sometido al enfrentamiento entre el Estado y determinadas Comunidades Autónomas que reclaman mayores capacidades regulatorias en todos los ámbitos y, en especial, en el financiero pues, al fin y al cabo, es lo que les otorga verdadera autonomía. Así, en el presente trabajo analizaremos el sistema de financiación autonómica actual y sus problemas, así como también propondremos soluciones a éstos.

The enactment of the 1978 Constitution and Organic Law 8/1980 on the Financing of Autonomous Communities led to the creation of the Autonomous State in Spain, whose bases are the territorial organization structured into municipalities, provinces and Autonomous Communities. Since then, Spain has undergone a process of decentralization with the approval and reform of the Statutes of Autonomy, as well as with its integration into Europe, with the Autonomous Regions gaining ever greater financial autonomy to the detriment of the State. However, with the financial crisis of 2008 this system staggered, demanding reforms that took place in 2009 and which, however, failed to satisfy the demands of the autonomous public administrations or the needs that the autonomous financing system itself demanded. In this way and according to the 2017 Report of the Committee of Experts for the reform of the financial system, today we find a system that suffers from problems of financial sufficiency, equity and efficiency and is subject to confrontation between the State and certain Autonomous Communities that demand greater regulatory capacities in all spheres and, in particular, in the financial sphere because, after all, it is what grants them true autonomy. Thus, in this paper we will analyze the current system of autonomous financing and its problems, as well as propose solutions to them.
