Pederastia y repercusiones forenses

Abstract

Tanto pederastia como pedofilia, puede dar lugar a confusiones hoy en día. Un pedófilo puede ser o no pederasta, pero un pederasta siempre va a ser pedófilo. Actualmente, pederastia se define como el abuso sexual cometido a niños por parte de un adulto. En el presente trabajo se va realizar una revisión bibliográfica acerca de la pederastia desde una conceptualización tanto clínica como psicolegal. Se abarcarán temas como puede ser los tratamientos que pueden llevarse a cabo, la eficacia que tienen así como si existe riesgo de peligrosidad o reincidencia a pesar de haber cumplido con el tratamiento. Por otro lado, trataremos el tema de la etiología, que nos dice la importancia que tienen las familias en este tipo de casos, y las posibles repercusiones que pueden tener éstas en estas en los agresores, así como las posibles tipologías en las que podemos clasificar este fenómeno. En cuanto a la dimensión forense se analizará este concepto así como la presencia de éste fenómeno en los órganos judiciales del sistema español, centrándonos en el Tribunal Supremo, analizando sentencias que abarquen este tipo de delito, teniendo siempre en cuenta y analizando el marco legal con el que nos encontramos en nuestro Código Penal.

Nowadays, the concepts of pederasty and pedophilia can often lead into misunderstandings and confusions. Whereas the pedophile, may or may not be a pederast, a pederast will always be a pedophile. The concept of pederasty is defined as the sexual abuse of a child by an adult. In this paper, we will review the existing literature of both clinic and pshyco-legal aproach of pederasty. Furthermore, we will cover diverse topics including potential treatments, their efficacy and the risks derived from their prospective dangerousness and recurrence. On the other hand, this work will examine the etiology behind the importance of family in pederasty cases, the wide range of implications that could have this type of families un the offender and the possible typologies into which we can classify this phenomenon. Turning into the forensic dimension, is going to be neccesary to analyze the relevance and presence of pederasty at the corresponding judicial organs in the Spanish system, focusing on the Supreme Court.
