Tratamiento jurídico-penal del consumo de drogas. Especial consideración del consumidor-drogodependiente y traficante de drogas

Abstract

Se ha realizado una revisión de cómo se encuentra regulado el delito de tráfico de drogas en España. Un análisis de la ley, la doctrina y las fuentes jurisprudenciales en relación con este delito, así como su tratamiento jurídico-penal. Para, a continuación, examinar la figura del traficante-drogodependiente, vulgarmente conocido como “camello”, y como le afecta la justicia a esta persona. Por un lado, debería ser condenado por el delito de tráfico de drogas, pero al ser consumidor, su pena se podría ver reducida, dando lugar a una situación un tanto paradójica, ya que el consumo de estupefacientes ha servido para atenuar el delito por traficar con sustancias tóxicas. Es lo que se considera “delincuencia funcional” y queda regulada dentro del artículo 21.2 del Código Penal Español. Los juristas no se han mostrado indiferentes ante la aplicación de la atenuante, y ha sido objeto de estudio y controversia entre juristas.

There has been a review about drug traffic regulation in Spain. A law analysis, the doctrine and the jurisprudential sources in relation with this crime, and its legal-criminal treatment. To examine the figure of the drug addict trafficker known as ''camello''(drug dealer) and how justice affects this person. On one hand he should be condemned for the offense of drug trafficking, but as he is a drug addict his jail sentence could be reduced, that gives places to a rare situation because drug consumption has served to attenuate the crime of drug trafficking. Thats known as ''delincuencia funcional'' (functional crime) and it is regulated in the article 21.2 of the Spanish Criminal Code. The jurists have not shown indifferent to the aplication of the attenuant and it has been a subject of dicussion and controversy between the jurists
