AUTODETERMINACIÓN POLÍTICA Y DERECHO DE AUTODETERMINACIÓN

Abstract

El presente trabajo pretende ser un estudio con un doble enfoque de la autodeterminación: la autodeterminación política y el derecho de autodeterminación. Equivocadamente asociado como sinónimo de secesión, se observará como ambas constituyen dos perspectivas de un mismo fenómeno difusamente definido, lo que ha provocado una confusión a la hora de emplear este término en el discurso político y jurídico actual. La autodeterminación puede plantear, por tanto, problemas para identificar los supuestos en los que será aplicable. Mediante una casuística ejemplificadora basada en las características del sujeto que lo invoca, se determinará la aplicación práctica de la autodeterminación y se observará en qué casos procede la secesión.

The present work aims to be a study with a double focus of self-determination: political self-determination and the right to self-determination. Wrongly associated as a synonym of secession, it will be seen how both constitute two perspectives of the same phenomenon diffusely defined, which has caused confusion when using this term in the current political and legal discourse. Self-determination can therefore pose problems in identifying the cases in which it will be applicable. Through an exemplary casuistry based on the characteristics of the subject that invokes it, the practical application of self-determination will be determined and it will be observed in which cases the secession proceeds.
