El trastorno mental transitorio en la jurisprudencia española

Abstract

El Código Penal recoge la circunstancia eximente de la responsabilidad del Trastorno Mental Transitorio en el párrafo segundo del art. 20.1, en relación con las anomalías y alteraciones psíquicas. Es un tipo abierto, cuya finalidad es poder subsumir circunstancias de muy diversa índole. Con todo, existen una serie de requisitos (causa suficiente; anulación de las capacidades cognitivas y volitivas; y no preordenación, previsión o deber de previsión) que han de cumplirse para su aceptación. Además, la jurisprudencia que se ha ido elaborando entorno a este concepto lo ha ido acotando en diferentes direcciones, resultando en una aplicación inconsistente del artículo. En este trabajo se desarrolla una clasificación mediante la revisión de sentencias que identifica el patrón de aplicación de este artículo.

The Spanish Penal Code gathers the “transient mental disorder” as one of the circumstances for denial of offending, found in the second paragraph of article 20.1, associated to the psychic anomalies and disturbances. The concept is rather undefined, which allows for it to be applicable in a wide variety of circumstances. Nevertheless, in order for it to be accepted the situation needs to fulfill some requirements (an actual cause; annulment of the cognitive ability and will; and no foreordination, no anticipation, and no duty to anticipate). Furthermore, Spanish precedents have developed in different directions, resulting in an inconsistent implementation of the article. This piece of work establishes a case-law based classification, which intends to identify a pattern in the implementation.
