¿Guarda y custodia exclusiva o compartida?: las consecuencias negativas en los hijos.

Abstract

En el presente trabajo, se realiza una revisión sistemática de artículos de investigación para conocer las consecuencias negativas que pueden manifestarse en los hijos de familias divorciadas o separadas, los diferentes tipos de guarda y custodia. En primer lugar, se expondrá una breve aproximación conceptual a cerca del significado de la patria potestad y la guarda y custodia de los menores, los tipos de guarda y custodia que existen actualmente en el Código Civil español y, la evolución de las decisiones judiciales en esta materia desde que se conocen datos. A continuación, se reflejarán los resultados de los estudios comparativos encontrados realizados en Estados Unidos, Europa y Australia. También se conocerán los motivos de la importancia de la conflictividad parental antes y después del divorcio o separación, y diversas perspectivas de organizaciones españolas de padres que comentan la conveniencia de la custodia compartida. Por último, se realizará una interpretación de los resultados encontrados, se plasmarán diferentes recomendaciones para la asignación de guarda y custodia y se comentarán futuras líneas de investigación en la materia.

In the present work, a systematic review of research articles is carried out to know the negative consequences that may arise in the children of divorced or separated families, the different types of guardianship and custody. First, a brief conceptual approach will be presented about the meaning of parental authority and the custody of minors, the types of custody and custody that currently exist in the Spanish Civil Code, and the evolution of judicial decisions in this matter since data are known. Next, the results of the comparative studies found in the United States, Europe and Australia will be presented. The reasons for the importance of parental conflict before and after divorce or separation will also be known, and various perspectives from Spanish parent organizations that comment on the convenience of joint custody. Finally, an interpretation of the results found will be made, different recommendations for the allocation of custody and custody will be made and future lines of research on the subject will be discussed.
