Valoración crítica de la Circular Circular 7/2019 de la Fiscalía general del Estado sobre la interpretación y aplicación de los delitos de odio

Abstract

Como es sabido la Ley Orgánica 1/2015 modificó el art. 510 del CP español dando una nueva redacción a los llamados delitos de odio y al discurso del odio. Cuatro años después la Fiscalía General del Estado ha publicado su Circular 7/2019, de 14/05/2019, con el propósito de fijar las pautas interpretativas de las distintas figuras delictivas que se contienen en el art. 510. La Fiscalía General valora que el nuevo art. 510 todavía presenta en su tipicidad unos contornos difusos que, sin duda, dificultan su detección y que, quizá, no permiten que afloren penalmente toda la variedad de conductas que presenta el fenómeno de la intolerancia excluyente , en expresión de la STC nº 177/2015, de 22 de julio . La ponencia que se presenta pretende realizar una valoración crítica, a la luz de los parámetros doctrinales, del contenido de la Circular de la Fiscalía General.
