Prisión permanente revisable: una cadena perpetua encubierta

Abstract

La entrada en vigor de la Ley Orgánica 1/2015, de 30 de marzo, por la cual se modifica la Ley Orgánica 10/1995, de 23 de noviembre del Código Penal, introdujo numerosas reformas, entre las cuales cabe destacar una que ha generado una gran controversia entre parte de la doctrina, la nueva pena de prisión permanente revisable, objeto de estudio de este trabajo. Se analiza la evolución de la regulación de esta condena entre los distintos Códigos Penales hasta llegar a la legislación actual. Además de realizar un estudio detallado de las características de esta pena, se plantea su posible inconstitucionalidad y vulneración del principio de non bis in ídem en determinadas situaciones.

The entry into force of the Organic Law 1/2015, of 30 March, amending Organic Law 10/1995, of 23 November, on the Criminal Code, introduced numerous reforms, among which one that has generated a great deal of controversy among some of the doctrine, the new penalty of permanent revisable prison, which is the aim of this work. The evolution of the regulation of this penalty between the different Criminal Codes up to the current legislation is analysed. In addition to carrying out a detailed study of the characteristics of this penalty, it raises the question of its possible unconstitutionality and violation of the principle of non bis in idem in certain situations.
