La violencia filio parental. El menor como sujeto activo y pasivo de la violencia

Abstract

La Violencia Filio-Parental, en sentido ascendente, ha sido una realidad oculta en nuestra sociedad hasta hace una década. Gracias a la evolución de la sociedad y el paso del tiempo, los padres han ido tomando consciencia de la gravedad de la situación y han intentado poner remedio a estas situaciones poniéndolas en conocimiento de las autoridades judiciales. Al mismo tiempo, siguen existiendo casos de Violencia Filio-Parental, en sentido descendente, en las que los padres se extralimitan en el derecho de corrección que creen en algunos casos ostentar de manera absoluta. En este trabajo analizaremos los distintos tipos de Violencia Filio-Parental que existen al igual que las causas y perfiles de víctimas y victimarios para intentar sacar un patrón de conductas común. De la misma manera, atenderemos la evolución del derecho de corrección de los padres sobre sus hijos debido a las sucesivas reformas operadas en el Código Civil, sus límites y la diferencia de este con el abuso ejercido por los padres.

Philio-Parental Violence, in the ascending sense, has been a hidden reality in our society until a decade ago. Thanks to the evolution of society and the passage of time, parents have become aware of the seriousness of the situation and have tried to remedy these situations by bringing them to the attention of the judicial authorities. At the same time, there continue to be cases of Philio-Parental Violence, in a downward direction, in which parents exceed the right of correction that they believe they have absolutely. In this paper we will analyze the different types of Philio-Parental Violence that exist as well as the causes and profiles of victims and victimizers in an attempt to draw a common pattern of behavior. In the same way, we will attend the evolution of the right of correction of the parents on their children due to the successive reforms operated to the Civil Code, its limits and the difference of this one with the abuse exercised by the parents.
