Psicopatía y Responsabilidad penal

Abstract

En el presente trabajo se pretende realizar una revisión bibliográfica sobre la psicopatía y su relación con la responsabilidad penal. Para ello se revisará qué el concepto actual de psicopatía, sus características y diagnóstico, centrándonos especialmente en las cuestiones relacionadas con la jurisprudencia española y psicopatía. Se analizan las posturas adoptadas por el sistema judicial español acerca de la responsabilidad penal o criminal hacia el delincuente psicópata, y cómo la anomalía mental que padece puede o no modificar su imputabilidad frente a los Tribunales y la Ley Española. Además, se revisan posibles consecuencias que la imputabilidad pueda tener sobre el delincuente psicópata y cómo se trata este tema de la responsabilidad penal de los psicópatas en Inglaterra y Estados Unidos a modo de comparación de la doctrina española con otras donde la prevalencia psicopática penitenciaria también parece ser elevada.

In the present thesis we intend to carry out a bibliographic review about psychopathy and its relationship with criminal liability. The characteristics and possible diagnosis of psychopathy will also be reviewed, especially when it comes to Spanish jurisprudence and its decision-making when dealing with psychopathy. An analysis carried out about the several positions that the Spanish Judicial System adopts towards the criminal responsibility of the psychopathic criminal is also carried out, as well as how this mental disorder they suffer, may or may not, be a leading factor towards the modification of criminal responsibility when facing the Courts and Spanish Law. In addition, the possible consequences that the criminal responsibility can have on the psychopathic criminal and how this issue is handled on England and amongst the United States are also reviewed, this has been seen as a way of comparing the Spanish doctrine along with others where psychopathic prison prevalence also seems be high.
